CFTC Commitment of Traders reports are published each Friday and reflect positions held as of the preceding Tuesday. All COT data on this platform is inherently delayed by a minimum of three calendar days and up to ten calendar days. Market conditions can change materially during this lag. You must account for this delay in any use of the data.
Data is sourced from public CFTC reports, ICE publications, and third-party market data providers. Any of these sources may publish incorrect, incomplete, late, or subsequently revised data. COTInsight's own automated processing pipeline may introduce additional errors, miscalculations, or display anomalies. No human reviews data outputs before they are displayed. COTInsight makes no warranty of any kind regarding the accuracy, completeness, timeliness, or fitness of any data shown.
The Service itself may be unavailable, offline, degraded, or returning incorrect results at any time due to technical failures, server outages, maintenance, third-party infrastructure issues, or any other reason. The fact that the Service is accessible does not mean the data displayed is current or correct. You must independently verify all data before acting on it, at all times, regardless of what this platform shows.

If you do not agree to any of these Terms, you must not use the Service. You must be at least 18 years of age to use the Service.
COTInsight is a web-based analytics platform that processes and displays public CFTC Commitment of Traders data and related market positioning signals. The Service is provided on a subscription basis with a free trial period and paid tiers.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity under your account. Accounts are for individual use only and may not be shared.
If you believe a billing error has occurred, you must contact us at support@cotinsight.com within 30 days of the charge. We will investigate and, where an error is confirmed, issue a correction or credit. We aim to resolve billing disputes within 10 business days.
All payment processing is handled by Stripe, Inc. Disputes arising from card processing, declined charges, or Stripe-side errors are subject to Stripe's dispute resolution procedures in addition to these Terms.
Initiating a chargeback or payment reversal with your card issuer without first contacting us constitutes a material breach of these Terms. We reserve the right to immediately suspend or terminate access to the Service upon receipt of a chargeback notification and to recover any associated fees or costs. Accounts subject to a chargeback may be permanently barred from re-subscribing.
Where applicable consumer protection law (including EU Directive 2011/83/EU or equivalent Swiss or US state regulations) grants you a statutory right of withdrawal or refund, that right is not affected by these Terms.
You may not: scrape, resell, or redistribute data from the Service; use automated tools to access the API beyond permitted rate limits; attempt to circumvent access controls or share account credentials; use the Service for any unlawful purpose.
The underlying CFTC COT data is public domain. The Service's software, UI, analytics methodologies, signal calculations, and commentary are proprietary to COTInsight. You may not copy, reproduce, or create derivative works without written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COTInsight EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, UNINTERRUPTED AVAILABILITY, AND FITNESS FOR TRADING OR INVESTMENT PURPOSES.
Data: We do not warrant that any data, figure, calculation, z-score, COT index value, or positioning output displayed on the Service is accurate, complete, current, or free from errors. All data is sourced from third-party providers (including the CFTC) and processed by automated algorithms. No human review of data outputs is performed before display. Data may be incorrect, incomplete, delayed, missing, revised, or unavailable at any time and without notice. Source data published by the CFTC is itself subject to revision and restatement. You are solely responsible for verifying any data independently before acting on it.
Service availability: We do not warrant that the Service will be available continuously, without interruption, or free from technical failures. The Service may be suspended, interrupted, degraded, or taken offline at any time for any reason, including maintenance, technical failure, third-party outages, security incidents, or at the operator's discretion, with or without prior notice and without liability. We make no commitment to any uptime level or service level agreement of any kind.
Modifications: We reserve the right to modify, suspend, discontinue, or remove any feature, function, data feed, instrument coverage, or aspect of the Service at any time, with or without notice, without liability to you or any third party.

Our total aggregate liability to you for any and all claims arising out of or in connection with these Terms or the Service shall not exceed the total subscription fees actually paid by you in the six months immediately preceding the event giving rise to the claim. This limitation applies cumulatively to all claims and shall not be circumvented by framing multiple claims or theories of recovery.
By accepting these Terms, you agree to the limitations set forth in this section as a fundamental and material condition of your access to the Service, without which the Service would not be made available to you. You expressly waive any right to argue that any limitation in this section is unenforceable, unconscionable, or inapplicable to your situation. If you do not accept these limitations in full, you must not use the Service.
You agree to indemnify, defend, and hold harmless COTInsight, its operator, affiliates, licensors, service providers, and each of their respective officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms or the Risk Disclaimer; (c) any trading decision, investment decision, or financial transaction you make in connection with your use of the Service; (d) your violation of any applicable law or regulation; or (e) any claim by a third party that your use of the Service caused them harm. This indemnification obligation survives termination of your account and these Terms.
Nothing in these Terms, and nothing in your use of the Service, creates or implies any fiduciary duty, advisory relationship, broker-dealer relationship, commodity trading adviser relationship, agency, partnership, joint venture, or employment relationship between you and COTInsight or its operator. We are a data provider. You are the sole decision-maker with respect to any use you make of the information available through the Service.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN OR BRING A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING AGAINST COTInsight OR ITS OPERATOR. All claims must be brought solely in your individual capacity. If this waiver is found unenforceable in your jurisdiction, it shall be severed and the remaining Terms shall remain in full force. To the extent permitted by law, each party also waives the right to a jury trial in any action arising from or related to these Terms.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice. Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 8, 9, 10, 11, 12, 14, and 17 — shall survive indefinitely. You may request deletion of your account at any time by contacting support@cotinsight.com.
Governing law: These Terms, the Risk Disclaimer, and the Privacy Policy, and all disputes or claims arising out of or in connection with them (including non-contractual disputes), are governed exclusively by the substantive laws of Switzerland, in particular the Swiss Code of Obligations (CO). The United Nations Convention on Contracts for the International Sale of Goods (CISG) and Swiss private international law rules are expressly excluded. Swiss law governs all substantive matters for all users in all jurisdictions without exception.
Mandatory arbitration — all users: ALL disputes, claims, or controversies arising out of or relating to these Terms, the Service, your account, any data or output, any billing matter, or any trading-related claim in connection with your use of the Service shall be resolved exclusively by final and binding individual arbitration administered by the International Chamber of Commerce (ICC) under its Rules of Arbitration. No user in any jurisdiction may initiate court proceedings in connection with any such dispute, except for urgent interim relief as described below. By using the Service, you irrevocably waive any right to initiate or participate in any court proceeding in any jurisdiction in connection with any such dispute.
The seat of arbitration shall be the jurisdiction designated by the operator in writing at the commencement of proceedings. The operator's designation is final and binding. The arbitration shall be conducted in English by a sole arbitrator applying Swiss substantive law. The award shall be final and binding on all parties. Enforcement shall be governed by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention, 1958). To the extent US federal law is applicable, the Federal Arbitration Act (9 U.S.C. § 1 et seq.) also governs the validity and enforceability of this arbitration agreement, but does not require the application of any particular arbitration rules or administrator.
YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ARBITRATION OR ACTION IN ANY FORUM. All claims must be brought solely on an individual basis. If this waiver is held unenforceable for a specific claim, that claim alone shall be severed; all other claims remain subject to individual arbitration under this section.
Exclusive forum for interim relief: The sole court with jurisdiction to grant urgent injunctive or interim relief in connection with any dispute under these Terms is the competent court of the jurisdiction designated by the operator. You irrevocably submit to the exclusive jurisdiction of those courts for that limited purpose only and waive any objection to venue, jurisdiction, or forum non conveniens therein.
Anti-suit: If you initiate any court proceeding in any jurisdiction other than as expressly permitted above, you agree to immediately discontinue that proceeding upon the operator's written request. The operator shall be entitled to recover all legal fees and costs incurred in securing that discontinuation or in obtaining a stay or dismissal of such proceedings.
Limitation period: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE DATE THE CAUSE OF ACTION AROSE, OR IT IS PERMANENTLY AND IRREVOCABLY BARRED. You expressly agree to this limitation as a material condition of access to the Service, regardless of any longer period under applicable law.
COTInsight shall not be liable for any failure or delay in performance of the Service resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, internet or infrastructure outages, CFTC publication delays, third-party data provider failures, or any other event outside our direct control. During such events, our obligations under these Terms are suspended for the duration of the force majeure event.
These Terms of Service, together with the Privacy Policy and Risk Disclaimer (all incorporated herein by reference), constitute the entire agreement between you and the operator with respect to the Service and supersede all prior agreements, representations, and understandings, whether written or oral. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect. Failure by COTInsight to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision unless acknowledged and agreed to in writing.
The Service is operated for a global audience. We make no representation that the Service is appropriate, permitted, or lawful in every jurisdiction. You are solely responsible for determining whether your access to and use of the Service complies with all applicable laws and regulations in your jurisdiction, including financial services laws, data protection laws, and any licensing or registration requirements.
United States — Regulatory Status: The operator of this Service is not registered with the U.S. Commodity Futures Trading Commission (CFTC), the National Futures Association (NFA), the U.S. Securities and Exchange Commission (SEC), or any US state securities or financial regulatory authority. The operator is not a registered Commodity Trading Advisor (CTA), Investment Adviser, broker-dealer, futures commission merchant, introducing broker, or any other regulated financial intermediary under US federal or state law.

Categories of personal information collected (CCPA disclosure): Identifiers (email address, IP address); commercial information (subscription tier, billing status); internet or network activity (server logs, pages visited). We do not collect geolocation data, biometric data, or inferences drawn to create profiles.
We do not sell personal information as defined under any US state privacy law. We do not share personal information with third parties for cross-context behavioral advertising.
We do not use cookies for tracking, analytics, or advertising. Your authentication token is stored in your browser's localStorage and is used only to maintain your session. It contains no personal identifiers beyond a cryptographically signed session token. You can clear it at any time by logging out or clearing your browser's local storage. No third-party scripts or tracking pixels are loaded by this Service.
We implement reasonable technical and organisational measures to protect your personal data, including bcrypt password hashing (work factor 12) and TLS 1.2 or higher for all data in transit. Access to personal data is restricted to technical operations required to run the Service. However, no method of transmission over the internet and no data storage system can be guaranteed to be unconditionally secure. We cannot warrant or guarantee the absolute security of your data, and you use the Service at your own risk in this regard.
